1. Welcome to GlotDojo

Thank you for using GlotDojo (“GlotDojo”, “we”, “us”, “our”). These are the terms of Use (“Terms”), which apply to your use of the Site, Chrome extensions (“Extension"), our mobile applications (“App”) and related services (collectively, such services, including any new features and applications, and the Site, the “Service(s)”). For information on how information is gathered and used at the Site, in the Extension, and on the App, please go to our Privacy Policy. The Privacy Policy is incorporated into these Terms by reference. GlotDojo is provided to you by eJOY, Inc. (“eJOY”), these Terms of Service, therefore, constitute an agreement between you and eJOY. If you do not agree to these Terms, you must discontinue using the Services and terminate your registration with us. It is your responsibility to regularly check the Site to determine if there have been changes to these Terms of Service and to review such changes.

Besides, when using certain services, you shall be subject to any additional terms applicable to such services that may be posted on the Service from time to time, including, without limitation, the Privacy Policy. All such terms are hereby incorporated by reference into these Terms of Service.

2. Registration and security

By completing the registration process for any given Services, you are agreeing to subscribe to the selected Services, subject to the terms and conditions of this Agreement. You agree to provide GlotDojo with accurate and complete registration information and to promptly notify GlotDojo in the event of any changes to any such information.

You shall be solely responsible for the security and proper use of all user IDs, passwords, or other security devices used in connection with the Site and/or the Services, and shall take all reasonable steps to ensure that they are kept confidential and secure, are used properly and are not disclosed to or used by any other person or entity. You shall immediately inform GlotDojo if there is any reason to believe that a user ID, password, or any other security device issued by GlotDojo has or is likely to become known to someone not authorized to use it, or is being or is likely to be used in an unauthorized way. GlotDojo reserves the right (at its sole discretion) to request that you change your password(s) in connection with the Services, and you shall promptly comply with any such request.

You are solely responsible for all activity in connection with access to the Site and/or Services through your account or using your password, and for the security of your computer systems, and in no event shall GlotDojo be liable for any loss or damages relating to such activity.

3. User Content

You are solely responsible for all information, data, text, software, music, sound, photographs, graphics, video, messages or other materials (“Content”) that you upload, post, publish or display or email or otherwise transmit or use via the Services. You understand that whether or not Your Content is published, we do not guarantee confidentiality with respect thereto.

4. Link to and from other websites (Third Party Websites)

The Services may contain third-party-owned content and links to other websites, including, but not limited to Google, Bing, Wikipedia (“Third Party Websites”). We do not endorse, sponsor, recommend, or otherwise accept responsibility for any Third Party Websites. Besides, Third-Party Websites are not under our control and we are not responsible for the content or privacy practices of the Third Party Websites, including, without limitation, links contained on Third Party Websites or any changes or updates to Third Party Websites. You further acknowledge and agree that GlotDojo shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any content, events, goods or services available on or through Third Party Websites. Any dealings you have with Third Parties found while using the Services are between you and the Third Party, and you agree that GlotDojo is not liable for any loss or claim that you may have against any such Third Party.

5. Correction

There may be information on the Site and our digital services that contains typographical errors, inaccuracies, or inadequate information on descriptions, pricing, availability, and other information. We reserve the right to correct any errors, inaccuracies, or inadequate information without prior notice.

6.  Termination of registration

GlotDojo may terminate your access and use of the Services immediately at any time, for any reason, and at such time you will have no further right to use the Services if, at GlotDojo's sole discretion, you fail to comply with any of the Terms.

7.  Indemnity

You agree to release, indemnify and hold us, our officers, employees, contractors, suppliers, affiliates, agents and licensors harmless from any losses, damages, cost, expense (including reasonable legal fees) or other liability, arising out of any claim, demand, allegation or proceeding brought by any third party due to, or arising out of your User Product, your use of the Services, your connection to the Services, your breach of the Terms, or your violation of any rights of another person or entity.

8. Cancellation & Refund Policy

You can cancel your subscription with GlotDojo at any time and for any reasons whatsoever. However, by accepting this refund policy, you agree that all sales are final and non-refundable. This policy applies to all purchasable online services that GlotDojo provides, including GlotDojo PRO Chinese Add-on and PRO Japanese Add-on, until there is further notice.

GlotDojo will not refund once your purchases have been made, whether via cash, bank transfer, credit card, Paypal or other payment methods. You are solely responsible for your purchase decision and we will not provide refunds under any circumstances, including change of mind or download by mistake.

9. Deleting Account

You can delete your account and terminate your use of the Services at any time by locating the ‘delete profile’ option in the settings section of your Profile. Once you have deleted your account, you will no longer have access to your profile and we will delete all data associated with your account. We accept no liability for the deletion of information or content from your Profile. You acknowledge and accept that certain User Content may remain after the deletion of your Profile and that the User Content Licence shall not be revoked or terminated. You can not recover the account you have deleted. Each email address can only be connected to one GlotDojo account at a time, and deleting an account won't free the email up for use on another account. If you want to use this account’s email address on another GlotDojo account, you need to change the email address connected to your account on the settings page before you delete your account. Once you change the email address, you can delete the account and use your original email address on another GlotDojo account.

10. Limitation of liability

In no event shall GlotDojo or its affiliates be liable to you for any indirect, incidental, special, consequential or exemplary damages or loss whatsoever, including but not limited to the loss of profits, goodwill, business interruption inaccurate results, loss or corruption of your content or any data, your inability to use the service, even if GlotDojo has been advised of the possibility of such damages and whether such damages arise in contract, negligence, tort, under the statute, in equity, at law, or otherwise.

Under no circumstances will GlotDojo’s total liability to you for all damages, losses or causes of action exceed the amount you have paid GlotDojo in the last 6 (12) months, or if greater, fifty ($100)dollars.

The Site contains materials, including software in source code form, which is submitted by third parties for inclusion on the Site. GlotDojo is committed to protecting the rights of copyright holders and seeks to comply with all applicable laws and regulations regarding the protection of intellectual property.

WITHOUT LIMITING ANY OF THE FOREGOING, THE CONTENT OF THE SITE IS PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.

12. Disclaimer of Warranties

You understand that your use of the Services is at your sole risk. The Services are provided to you on an “as is” and “as available” basis. GlotDojo makes no representations or warranties of any kind with respect to the Services, whether express, implied or statutory, including, but not limited to the warranties of merchantability, fitness for a particular purpose, title and non-infringement.
GlotDojo makes no warranty that (i) The Services will meet your requirements, (ii) The Services will be uninterrupted, timely, secure, or error-free, (iii) The results obtained from your use of the Services will be accurate, reliable, and complete.
Access and use of the Services may be slow, limited, or unavailable during periods of peak demand, system upgrades, malfunctions or scheduled or unscheduled maintenance without prior notice, or for any other reason beyond our reasonable control.

The online resources to which this site gives access are protected by copyright law. You must respect the respective owner's copyright notices published on their sites.

We may change the Terms from time to time by updating this posting and changing the Effective Date referenced below. These Terms are the entire agreement between you and GlotDojo. They supersede any prior or contemporaneous agreements between you and GlotDojo relating to your use of the Site or the Services. The failure of GlotDojo to partially or fully exercise any rights or the waiver of GlotDojo of any breach of these Terms by you, shall not prevent a subsequent exercise of such right by GlotDojo or be deemed a waiver by GlotDojo of any subsequent breach by you of the same or any other term of these Terms. The rights and remedies of GlotDojo under these Terms and any other applicable agreement between you and GlotDojo shall be cumulative, and the exercise of any such right or remedy shall not limit GlotDojo's right to exercise any other right or remedy. These Terms are governed by, and will be interpreted under the laws of Vietnam, without regard to any choice of law provisions.
